This Privacy Policy (the “Policy”) governs the manner in which FLTECHS LLC (“FLTECHS,” “we,” “our,” or “us”) collects, uses, maintains, discloses, and protects personal information in connection with the services we provide, including but not limited to Voice over Internet Protocol (VoIP) services, information technology (IT) support and consulting, and website development and management (collectively, the “Services”).

By engaging with FLTECHS for any of its Services, you (“you” or the “Customer”) consent to the terms of this Policy and agree to the collection and use of your personal information in accordance with the terms set forth herein.

1. SCOPE AND APPLICATION


This Policy applies to all data and personal information collected by FLTECHS from Customers, users, or visitors in connection with the use of our Services, communications with our team, or visits to our websites. This includes data collected through any digital platform, third-party application, communication system, or directly through technical support and onboarding processes.

2. INFORMATION WE COLLECT


FLTECHS may collect and process the following categories of information:

a. Identifying and Contact Information

Includes, but is not limited to, your name, company name, email address, phone number, business address, and billing details.

b. Service Usage and Diagnostic Information

Includes device identifiers, IP addresses, session logs, call records, system diagnostics, support inquiries, and performance metrics related to the use of VoIP, IT, and hosted web systems.

c. Communications and Interaction Data

Includes voice recordings, voicemail files, support chats, email correspondence, and user-submitted information through client portals or contact forms.

d. Website and Analytics Data

Includes traffic logs, user behavior analytics, browser type, and other technical data collected from websites hosted or managed by FLTECHS.

e. SMS and MMS Data

Includes message metadata, timestamps, delivery status, recipient and sender phone numbers, and message content (where applicable or required for compliance, diagnostics, or support).

3. USE OF INFORMATION

 FLTECHS uses collected information for the following lawful and business-related purposes:

  • To provide, maintain, and improve the Services;
  • To administer customer accounts and billing;
  • To deliver technical support, monitoring, and system updates;
  • To fulfill contractual obligations with Customers;
  • To ensure compliance with regulatory and carrier requirements;
  • To detect, investigate, and prevent security breaches, service abuse, or fraudulent activity;
  • To communicate service updates, policy changes, or legal notices.

4. SMS AND MESSAGING PRIVACY


FLTECHS offers SMS and MMS functionality as part of its VoIP communication services. Use of this functionality is governed by the following provisions:

a. Compliance and Consent Obligations

Customers are solely responsible for ensuring that all recipients of SMS or MMS communications have granted appropriate, legally sufficient consent. All use of messaging services must comply with applicable laws and regulatory frameworks, including but not limited to the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, and all applicable 10DLC registration and usage requirements.

b. Message Delivery and System Limitations

Message delivery is subject to the availability and limitations of third-party carrier networks. FLTECHS does not guarantee delivery and is not liable for failed or filtered messages due to carrier policies or external factors. Group messaging features may be restricted to one external contact per chat session. Forwarding of SMS to another number is not supported.

c. Retention and Data Access

SMS and MMS data may be retained for up to twelve (12) months for the purposes of service operation, diagnostics, and regulatory compliance. FLTECHS does not routinely monitor message content but may access such content:

  • Upon request of the Customer for troubleshooting;
  • When required to comply with lawful process or regulatory inquiry;
  • When investigating suspected misuse of the Services.

d. Prohibited Uses

Messaging services may not be used for unlawful, unsolicited, harassing, or fraudulent communication. Any use of the Services in violation of applicable law or carrier guidelines may result in immediate suspension or termination of messaging capabilities, at FLTECHS’s sole discretion.

5. DISCLOSURE OF INFORMATION


FLTECHS does not sell personal data. We may disclose information to third parties strictly as necessary to perform the Services or to comply with applicable law, including:

  • To telecommunications carriers, vendors, or subcontractors supporting service delivery;
  • To payment processors and billing providers;
  • To law enforcement, government agencies, or courts upon receipt of valid legal process;
  • In the event of a merger, acquisition, or sale of all or part of FLTECHS’s assets, provided such disclosure is subject to appropriate confidentiality measures.

6. DATA SECURITY


FLTECHS implements reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, or destruction. However, no method of electronic storage or transmission over the internet is guaranteed to be fully secure.

7. DATA RETENTION


FLTECHS retains personal data only for as long as necessary to fulfill the purposes outlined in this Policy or as required by applicable law. Data related to service usage, billing, technical logs, and communications may be retained for a period consistent with business needs, regulatory retention requirements, and contractual obligations.

8. CLIENT WEBSITE AND THIRD PARTY DATA


For websites hosted, developed, or managed by FLTECHS, we may have access to visitor logs, analytics data, and administrative content. In such cases, FLTECHS acts as a data processor and handles such data only as necessary to provide services to the Customer. We do not use or disclose third-party website visitor data for any independent purpose.

9. INDIVIDUAL RIGHTS


Subject to applicable law, you may have the right to:

  • Request access to your personal data;
  • Request correction or updates to inaccurate data;
  • Request deletion of your personal data, where permissible;
  • Object to processing or request restrictions on the use of your data;
  • Receive a copy of your data in a portable format.

10. CHANGES TO THIS POLICY

FLTECHS reserves the right to modify this Policy at any time. Any material changes will be communicated via email or posted prominently on our website. Your continued use of the Services after such modifications constitutes your acceptance of the updated Policy.
